Vyvern Companion Mods — License

This license applies to any software distributed under the identifier LicenseRef-Vyvern-Proprietary — currently: Vyvern Bridge, Vyvern Stats, Vyvern QOL, Vyvern Teams, Vyvern Mine, Vyvern Autopilot, Vyvern Voxy, Vyvern Updater, and Vyvern Updater Boot, and any future mod released under the same identifier (each, "the Software") — as distributed via Modrinth, the Vyvern companion package registry, or the Vyvern platform's pack-distribution feature.

1. Grant of Use

You are granted a free, worldwide, non-exclusive license to:

  1. Download, install, and run unmodified compiled copies of the Software on any Minecraft server or client, for any purpose — including commercial game-server hosting — with or without a connection to a Vyvern panel.
  2. Include unmodified compiled copies of the Software, together with this license, in a modpack or bundle for distribution to players — whether that bundle is assembled by you, by a third party, or generated automatically by the Vyvern platform (e.g. its .mrpack client-pack export) — provided the Software itself is not altered and this license is not removed or amended.

This grant is conditioned on the following:

  1. Wherever you publicly distribute, promote, or list the Software or a modpack containing it — including on a modpack page, a server's public website, store, or advertisement — you must include a clearly visible link to https://vyvern.io. A private server with no public listing has nothing to add a link to, and is unaffected by this condition.

2. Restrictions

Except as expressly permitted in Section 1, you may not:

  1. Decompile, disassemble, reverse-engineer, or otherwise attempt to derive the source code of the Software, except to the extent such restriction is prohibited by applicable law.
  2. Modify, translate, adapt, or create derivative works based on the Software.
  3. Rent, lease, sell, sublicense, or otherwise transfer the Software as a standalone paid product, or charge a fee specifically for access to it.
  4. Remove, obscure, or alter any copyright, trademark, or attribution notice contained in or displayed by the Software.
  5. Use the "Vyvern" name, logo, or branding to imply endorsement of, or affiliation with, any product or service not published by Vyvern, or to publish a modified or rebuilt version of the Software under the Vyvern name.
  6. Re-host the Software's binary files on any distribution channel other than the official Modrinth project, the official Vyvern companion package registry, or the Vyvern platform's own pack-distribution feature, as your own release or under your own name.

3. No Warranty

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU ASSUME ALL RISK FOR ANY DAMAGE TO YOUR SERVER, WORLDS, OR DATA ARISING FROM USE OF THE SOFTWARE.

4. Limitation of Liability

IN NO EVENT SHALL VYVERN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, WORLD CORRUPTION, DOWNTIME, OR LOST PROFITS, ARISING OUT OF OR RELATED TO THE USE OF, OR INABILITY TO USE, THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VYVERN'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR IT — WHICH, AS THE SOFTWARE IS DISTRIBUTED FREE OF CHARGE, IS ZERO.

5. Ownership

The Software is licensed, not sold. Vyvern retains all right, title, and interest in and to the Software, including all intellectual property rights in it. No rights are granted except those expressly stated in this license.

6. Termination

This license terminates automatically, without notice, if you breach any of its terms. Upon termination you must stop using and delete all copies of the Software in your possession. Sections 3, 4, and 5 survive termination.

7. Governing Law

This license is governed by the laws of Norway, without regard to its conflict-of-law principles. Any dispute arising from this license is subject to the exclusive jurisdiction of the Norwegian courts.
